　　【论文摘要】 我国刑事诉讼中超期羁押现象长期以来一直未能得到有效遏制,已经出台了的有关纠防超期羁押的制度也未得到真正落实.为此,本文在阐述了超期羁押的概念,危害性及其长期存在的原因的基础上,着重提出了一些解决超期羁押的对策:转变执法观念,提高执法人员素质;填补现行法律漏洞,完善羁押立法规定;完善对超期羁押的监督机制和救济程序;建立羁押的替代措施
